Amazon to open Tel Aviv office to support cloud services

TEL AVIV (Reuters) - Amazon.com will open an office in Tel Aviv to support its cloud computing offering called Amazon Web Services (AWS), the company's chief technology officer said on Tuesday.

The office is expected to begin operating at the start of 2014 and support companies from start-ups to large organizations as they move to cloud computing services offered by Amazon.

Companies in Israel, which has a large concentration of technology start-ups, were among the first to turn to cloud computing when AWS was established in 2006, the CTO said.

"If you start a business today you no longer buy IT (information technology). You spend your money on getting better engineers and product builders," Werner Vogels told a news conference.

AWS, which is the market leader in cloud computing, according to the latest Gartner research, rents remote computing and storage to other companies, providing over 30 different services.

Vogels said Amazon is focused on driving costs down and has lowered the price for its services 37 times since 2006.

"We've always know that this is not a winner take all market. There is room for many providers with differentiating products," he said.

(The story has been filed again to clarify that company is market leader according to research firm Gartner in paragraph five.)

Trouble's brewing in Android land

The Android OS dominates the mobile landscape, outselling all rivals combined in most countries. The only serious challenger, Apple's iOS, earns much more money for Apple than Android earns for Google and all its hardware partners combined, but when it comes to market share, Android is king. So why does the Android ecosystem appear to be troubled?

HTC is in disarray, as its Android sales struggle in the face of the dominant Samsung, which is the only Android device maker to profit from Android. Google's Nexus devices have so-so sales, perhaps because they tend to be middle-of-the-road devices that don't inspire large populations the way Samsung and Apple do. Ditto for its Motorola Mobility unit. In fact, Google seems to have backed off on Android, focusing instead on Chrome OS and its array of data-mining services, which is where the company actually makes its money.

[ InfoWorld picks the best office apps for Android. | Keep up on key mobile developments and insights via Twitter and with the Mobilize newsletter. ]

Then there's Samsung, which sells by far the most Android devices and makes real money from them. Yet it apparently has stolen secret Apple information in defiance of the courts, cheats on industry benchmarks, and abuses the patent system to undermine Apple, a key customer if also a key competitor. It also stoops to announcing all-but-nonexistent products, such as the curved-glass Samsung Round last week, a pathetic attempt to pretend to be first. (HTC plans a similar product, so Samsung cobbled together a prototype that may never actually reach the market.) Such actions reek of desperation, not success.

What's going on in Android land is a series of sometimes unrelated events that intertwine in ways that aren't good for Android's future.

HTC's desperation to matter again
For example, HTC's troubles are not so much about Android but about not delivering compelling products regularly. HTC was the first company to offer a compelling Android device, the Droid Eris, in 2009, then all but disappeared in terms of innovation for the next three years. Its products were run-of-the-mill, inspiring little passion. And users have complained for years that HTC smartphones tend to break after a year of operation. Although this year's HTC One is a stylish smartphone that's a personal favorite of mine, it has done little to make HTC a leader in the Android market.

As a result, the company is in chaos, according to news reports. It's losing money, has laid off employees, and may need to get an infusion of cash from another company, ending its independence.

Samsung's misguided and perhaps unethical strategy
Samsung holds the leadership role in Android, thanks to strong efforts in 2011 and 2012 to make innovative, compelling products, such as the Galaxy Note series of smartphones, the Note series of tablets, and the very nice Galaxy S III. This year's Galaxy S 4 may have jumped the shark, despite its improved physical design, because of its mishmash of partially completed software, but Samsung still has plenty of momentum from those earlier products in buyers' minds.

Canada to grant honorary citizenship to Malala Yousafzai

OTTAWA (Reuters) - Pakistani teenage activist Malala Yousafzai, who was shot in the head by the Taliban for campaigning for girls' education, will be granted honorary Canadian citizenship, the Canadian government announced on Wednesday.

She will join an elite group of foreign honorees who include South Africa's Nelson Mandela and Myanmar's Aung San Suu Kyi.

"Canada recognizes the courageous and inspiring example set by Malala Yousafzai in risking her life promoting education for young women," the government said in a speech setting out its priorities for the next two years.

"She faced down evil and oppression and now speaks boldly for those who are silenced."

After receiving death threats from the Taliban for defying the Islamist militant group with her outspoken views on the right to education, Yousafzai was shot a year ago while on a school bus near her village in Swat in northwestern Pakistan.

Microsoft Yanks Windows RT 8.1 Update “Temporarily” Following Discovery Of A “Situation”

If you are a Windows RT user looking forward to moving to Windows RT 8.1, you can’t, at least for a little while. Today Microsoft removed the update from the Windows Store following the uncovering of a “situation” that was “affecting a limited number of users updating their Windows RT devices to Windows RT 8.1.”

So, the code is now unavailable “temporarily” while Microsoft fixes whatever the heck is wrong. The issue appears to impact the booting cycle of some machines after they update.

Microsoft is likely pissed that it had to yank the update – it was hoping for a very smooth Windows 8.1 update cycle. Still, if the error had been present in the vanilla Windows 8.1 update, and not its RT flavor, the embarrassment would have been greatly magnified. Windows RT, of course, is a sliver when compared with Windows 8.

Aside from this error, the Windows 8.1 release cycle has been mostly smooth. There were reports of individual user problems, and a general meme was that the update process took longer than expected, but worked. Until today.

How many Windows RT users are there? I don’t know, but given that the majority are presumably Surface RT users, Microsoft is delaying those who both bought into its hardware efforts as well as its new software platform. That’s not a very good Saturday for the company.

Peter Bright of Ars Technica has the best analysis of the situation:

To call this embarrassing for Microsoft is something of an understatement. While x86 PCs have extraordinary diversity, in terms of hardware, software, and drivers—all things that can prevent straightforward upgrading—the Windows RT devices are extremely limited in this regard. Upgrading Windows RT tablets should be absolutely bulletproof. It’s very disappointing that it isn’t.

Precisely.

We’ll have preliminary market share numbers for Windows 8.1 upgrade cycle next week, though I don’t expect this specific bug to move those numbers too much.

Kerry Hopes Syria's Chemical Weapons Are Shipped Out Of The Region

Syria's chemical weapons could be consolidated and moved out of the country, Secretary of State John Kerry suggested in an interview with NPR.

Weapons inspectors are still in Syria assessing the country's stockpile and how to destroy it, in accordance with a United Nations Security Council resolution approved in September.

Asked by Morning Edition host Renee Montagne whether the agreement ensures that Syria's President Bashar Assad will remain in power, perhaps for many more months, Kerry replied:

"The fact is that these weapons can be removed whether Assad is there or not there because we know the locations, the locations have been declared, the locations are being secured. And my hope is that much of this material will be moved as rapidly [as] possibly into one location, and hopefully on a ship, and removed from the region."

Where such a ship would go is unclear, NPR's Michele Kelemen reports, and even the logistics of dealing with the weapons inside Syria are complicated.

"The Chemical Weapons Convention bars countries from moving their stockpiles — but in Syria's case, a U.N. resolution allows it and urges member states to help," Kelemen says.

Ralf Trapp, a consultant in chemical weapons disarmament, tells Kelemen that the idea of moving the material has been under discussion. However, he adds:

"It's a big, big logistical operation, and just doing this under peacetime conditions is not an easy job, so doing this under the conditions of Syria today is a challenge."

In an interview airing Thursday on Morning Edition, Kerry emphasized that the way forward in Syria would have to be diplomatic and that maintaining state institutions is key to future progress.

"There is no military solution. Absolutely not. There is only a continued rate of destruction and a creation of a humanitarian catastrophe for everybody in the region if the fighting continues," he said.

His remarks follow a two-week trip abroad, including two days in Kabul, where Kerry met with Afghan President Hamid Karzai. The leaders reached a deal on the terms of U.S. presence in Afghanistan after its combat mission ends.

"Everything that will be necessary to a successful agreement is in the agreement. We succeeded in defining exactly what the limits would be for American participation in the future," Kerry said.

But a council of public and tribal leaders, known as the Loya Jirga, still has to sign off on the issue of jurisdiction over Americans who would be working in Afghanistan.

"Needless to say, we are adamant it has to be the United States of America. That's the way it is everywhere else in the world," Kerry said. "And they have a choice: Either that's the way it is or there won't be any forces there of any kind."

Activists: Bomb near Syrian capital kills 16

BEIRUT (AP) — Syrian rebels assaulted a checkpoint in a pro-government suburb of Damascus on Saturday, setting off a suicide vehicle bomb that killed 16 soldiers, activists said.

The violence came a day after nine Shiite pilgrims from Lebanon kidnapped in Syria last year were freed as part of a negotiated hostage deal that could see two Turkish pilots held by Lebanese militants and dozens of Syrian women held in Syrian government jails released.

Lebanese Interior Minister Marwan Charbel said that the Syrian opposition had demanded that the female detainees be taken to Turkey. He said once that that issue was resolved then the complicated, multilateral exchange would be complete.

"We are speaking with the Syrians about this issue and, God willing, when this logistical matter ends the whole process will end," Charbel told the Al-Manar TV channel of Lebanon's Hezbollah group.

While details about the deal remained murky, it appeared to represent one of the more ambitious negotiated settlements to come out of Syria's civil war, now in its third year, where the contenting sides remain largely opposed to any bartered peace.

The pilgrims, who according to Charbel crossed into Turkey late Friday, were part of a group of 11 hostages taken by a rebel faction in northern Syria in May 2012. Two were later released, but the nine had been held since, causing friction in the region and sparking the August kidnapping in Beirut that saw two Turkish Airlines pilots abducted.

The two Turkish Airlines pilots, previously identified as Murat Akpinar and Murat Agca, were kidnapped after flying into Beirut from Istanbul on Aug. 9. Lebanon's state news agency reported that a group called Zuwaar al-Imam Rida, a name implying a Shiite affiliation, claimed responsibility for the kidnapping. The group said the pilots "will only be released when the Lebanese hostages in Syria return," referring to the Shiite pilgrims.

The pilgrims were kidnapped while on their way from Iran to Lebanon through Turkey and Syria. Militants kidnapped them shortly after they crossed the Turkish border into Syria.

Meanwhile, outside Damascus, rebels led by the al-Qaida-linked Jabhat al-Nusra or Nusra Front set off the bomb while assaulting a checkpoint near the town of Mleiha adjoining the suburb of Jaramana, the Britain-based Syrian Observatory for Human Rights reported. It reported heavy fighting after the blast.

The state news agency SANA confirmed the suicide blast in Jaramana and said it wounded 15 people, most of them seriously.

Rebels control much of the countryside around Damascus but Jaramana, a Christian and Druse area, is mostly loyal to President Bashar Assad. Opposition fighters have previously targeted it with bombings and mortar rounds.

Assad has drawn support from Syria's ethnic and religious minorities, including Christians and members of his Alawite sect. The rebels are dominated by Syria's Sunni Muslim majority.

At least 100,000 Syrians have been killed in the civil war.

Booty call! Kardashian selfie gets Kanye fired up

Celebs

Forget North, Kim Kardashian had us looking south at her latest Instagram photo — a revealing selfie-in-a-swimsuit that even drew boyfriend Kanye West into the spirited online reaction.

The photo, simply captioned #NoFilter, has more than 650,000 likes and 57,000 comments on Instagram, and shows the now-blonde reality TV star in a white bathing suit with her famous backside pointed at a mirror.

After the image hit Kardashian's Twitter feed, West responded early Thursday with an all-caps shout-out to the mother of his 4-month-old baby girl (and his 10 million followers): "HEADING HOME NOW."

A week ago, West was on "Jimmy Kimmel Live" discussing Twitter, his recent rant against the talk-show host and how people feel it's "OK to treat celebrities like zoo animals."

DuJour magazine profiled Kardashian in March, saying she was "fearless in the face of scrutiny and a hopeless romantic in a cynical age" — good thing, considering some of the comments on her new photo. In that article, Kardashian, 32, said, "My boyfriend has taught me a lot about privacy. I’m ready to be a little less open about some things, like my relationships. I’m realizing everyone doesn’t need to know everything. I’m shifting my priorities."

Vote for Your Favorite Actress Who Played Carrie!

Are you a big horror fan? If so, a very exciting adaptation is on its way: The new version of Carrie comes out today! Chloe Grace Moretz stars as the tortured high school student who gets her revenge at prom. It’s the third version of the book by Stephen King, so the question must be asked. Who was the best Carrie?

OK! News: Learn how to recreate Chloe Grace Moretz’s pretty waves!

Sissy Spacek played Carrie in the 1976 film by Brian De Palma, which is now a classic. Her Carrie was great because she seemed truly spacey and not of this realm throughout the movie, like a vulnerable alien. That is, until she attacks of course, and those giant eyes become full of evil instead of pain.

OK! News: See Chloe’s adorable #tbt Instagram!

Not many remember this movie, but The Rage: Carrie 2 was another entry to the genre in 2002. A slicker movie, it featured excellent turn-of-the-millennium stars like Jason London and Mena Suvari, with the main girl played by Emily Bergl (and actually called Rachel, not Carrie).

Photos: Take a look back at Kim Kardashian’s beauty transformation!

Lastly, Chloe Grace Moretz seems born to play Carrie (which is a compliment… we swear!). She seems almost too pretty to be hated by her classmates, but you definitely believe her rage.

Are you planning to see Carrie this weekend? What’s your favorite horror movie? Tell us in the comments below or tweet us @OKMagazine

(AP) — Andretti Autosport will announce a new primary sponsor Saturday to replace GoDaddy next season on the car currently driven by James Hinchcliffe.

Andretti gave no indication Friday on the progression of contract talks with Hinchcliffe, who with three wins this season gave GoDaddy its most successful season on track in its seven years with the organization.

GoDaddy joined Andretti as an associate sponsor for Danica Patrick in 2007, and the website domain provider became the primary sponsor on her car in 2010. GoDaddy moved with Patrick to NASCAR that season when she began dabbling in the Nationwide Series, and the company followed her there when she made a full-time move to the Sprint Cup Series.

But GoDaddy also stayed in IndyCar with Andretti, which planned to replace Patrick with Dan Wheldon prior to Wheldon's death in the 2011 season finale.

Hinchcliffe then got the No. 27 car and quickly developed into an IndyCar fan favorite off the track last season.

He turned it up on the track this season, winning his first career IndyCar race in the season-opener at St. Petersburg. Hinchcliffe later won in Brazil and Iowa.

Despite Hinchcliffe's success, GoDaddy has publicly said it was undecided on its future in IndyCar amid reports the company was pulling out.

With the season ending Saturday at Auto Club Speedway and Hinchcliffe on the free agent market, team owner Michael Andretti apparently felt he couldn't wait any longer and announced Friday he'd reveal a new sponsor before the race.

Blake Irving, who took over as CEO of GoDaddy in January, said in an interview with The Associated Press at the IndyCar race at Toronto that racing remained a valuable venue for GoDaddy and Hinchcliffe and Patrick were both strong brand ambassadors.

But Irving also said his long-term vision for GoDaddy was taking the company global next year, with an emphasis on World Cup and reaching Latin American markets.

(AP) — The duo of Tina Fey and Amy Poehler proved such a success at hosting the Golden Globes in January that they've been signed up for the same job for the next two years.

NBC, the Hollywood Foreign Press Association and producers of the Golden Globes announced the unusual two-year commitment on Tuesday. Next year's Golden Globes will be held in Beverly Hills, Calif., on Jan. 12.

Allen Shapiro, CEO of Dick Clark Productions, said the former "Saturday Night Live" chums have "a truly unique chemistry making them one of the most talented and captivating pairings of all time."

They were bathed in critical love for their performance this year, with The Associated Press critic Frazier Moore calling them "the night's biggest winners." They got laughs without being polarizing, as was the case with predecessor Ricky Gervais. Poehler even poked fun during the show at the Hollywood debate over whether Gervais was too hard-edged in mocking Hollywood stars.

"We want to assure you that we have no intention of being edgy or offensive tonight," said Poehler, star of the NBC sitcom "Parks and Recreation." "Because, as Ricky learned the hard way, when you run afoul of the Hollywood Foreign Press, they make you host this show two more times!"

Fey, whose NBC comedy "30 Rock" ended this year, and Poehler were both nominated for best actress in a comedy or musical but lost to Lena Dunham, star of HBO's "Girls."

More important than critical support, Fey and Poehler were good for business. The Golden Globes had their best ratings in six years for the most recent presentation, and were up 17 percent over the 2012 show.

WASHINGTON (AP) — The Justice Department on Thursday brought fresh charges against four former Blackwater Worldwide security contractors, resurrecting an internationally charged case over a deadly 2007 shooting on the streets of Baghdad.

A new grand jury indictment charges the men in a shooting that inflamed anti-American sentiment in Iraq and heightened diplomatic sensitivities amid an ongoing war. The men were hired to guard U.S. diplomats.

The guards are accused of opening fire in busy Nisoor Square on Sept. 16, 2007. Seventeen Iraqi civilians died, including women and children. Prosecutors say the heavily armed Blackwater convoy used machine guns and grenades in an unprovoked attack. Defense lawyers argue their clients are innocent men who were ambushed by Iraqi insurgents.

The guards were charged with manslaughter and weapons violations in 2008, but a federal judge the following year dismissed the case, ruling the Justice Department withheld evidence from a grand jury and violated the guards' constitutional rights. The dismissal outraged many Iraqis, who said it showed Americans consider themselves above the law. Vice President Joe Biden, speaking in Baghdad in 2010, expressed his "personal regret" for the shootings.

A federal appeals court reinstated the case in 2011, saying now-retired Judge Ricardo Urbina had wrongly interpreted the law.

Prosecutors again presented evidence before a grand jury, and U.S. District Judge Royce Lamberth gave the Justice Department until Monday to decide what to do with the case.

The defendants include Dustin Heard, a retired U.S. Marine from Knoxville, Tenn.; Evan Liberty, a retired U.S. Marine from Rochester, N.H.; Nick Slatten, a former U.S. Army sergeant from Sparta, Tenn., and Paul Slough, a U.S. Army veteran from Keller, Texas.

Slatten is charged with 14 counts of voluntary manslaughter and 16 counts of attempt to commit manslaughter; Liberty and Heard are charged with 13 counts of voluntary manslaughter and 16 counts of attempt to commit manslaughter; and Slough is charged with 13 counts of voluntary manslaughter and 18 counts of attempt to commit manslaughter. All four were also charged with one count of using and discharging a firearm during and in relation to a crime of violence.

They were charged under the Military Extraterritorial Jurisdiction Act, a statute that allows the government to prosecute certain government employees and contractors for crimes committed overseas. Defense lawyers have argued that statute does not apply in this case since the guards were working as State Department contractors, not for the military.

Heard's lawyer, David Schertler, said in an email he was disappointed with the prosecution, which he believes has no merit.

"We will continue to fight and defend Dustin Heard's innocence and honor until he is fully exonerated," he said.

Lawyers for Slough and Slatten declined to comment. Liberty's lawyer did not respond to requests for comment.

In a statement, U.S. Attorney Ronald C. Machen Jr. said the prosecution "demonstrates our commitment to upholding the rule of law even in times of war and to bringing justice to the memories of those innocent men, women and children who were gunned down in Baghdad more than six years ago."

Prosecutors last month agreed to dismiss their case against a fifth guard, Donald Ball, a retired Marine from West Valley City, Utah. A sixth guard, Jeremy Ridgeway of California, pleaded guilty and is awaiting sentencing.

The Justice Department had earlier dropped Slatten from the case, but after the appeals court decision reinstated the prosecution, the government said he remained a defendant.

The company formerly known as Blackwater Worldwide is under new ownership and is now headquartered in Virginia. It had changed its name to Xe Services, but the company was sold to a group of investors who then changed the name to Academi.

Blackwater founder Erik Prince is no longer affiliated with the company.

In moving forward with the case, the government will seek to overcome some of the legal problems that have dogged the prosecution. The case ran into trouble because the State Department promised the guards that their statements explaining what happened would not be used for criminal prosecution. The guards told investigators that they fired their weapons, a crucial admission. Because of a limited immunity deal, prosecutors had to build their case without those statements, a high legal hurdle. In dismissing the case, Urbina said prosecutors had read the statements, reviewed them in the investigation and used them to question witnesses and get search warrants.

Court documents also reveal conflicting evidence, with some witnesses saying the Blackwater convoy was under fire and others saying it was not.

6 ways social media can boost your business

October 16, 2013

If your company isn't fully taking advantage of social media, it might be missing out on opportunities to connect with customers, gain market share, and bring needed talent into the organization.

Experts say virtually every type of business can benefit from using social media as a business tool.

"We really are seeing interest and the potential for business value across the board," says Jeffrey Mann, research vice president at Gartner. "No one is immune, although it will be easier for some than others."

The most likely to see value, Mann says, are knowledge-based and highly collaborative industries, such as media, education, consulting, and high technology; industries or organizations that aren't hamstrung by regulation; and organizations with younger employees who are accustomed to working with social media.

Strong quake kills at least 74 in central Philippines

By Erik De Castro

CEBU CITY, Philippines (Reuters) - A powerful earthquake measuring 7.2 struck islands popular with tourists in the Philippines on Tuesday, killing at least 74 people, some as they prayed in a centuries-old church, and causing widespread damage to infrastructure, officials said.

Low-rise buildings collapsed on at least two islands and historic churches in the predominantly Catholic country cracked and crumbled during the quake, which sparked panic, cut power and transport links and forced hospitals to evacuate patients.

At least 65 people died in collapsed structures and landslides on the island of Bohol, 630 km (390 miles) south of the capital, according to a report from the region 7 office of the National Disaster Risk Reduction and Management Council (NDRRMC).

The report said eight others died in Cebu and another on Siquijor island. An earlier report had put the death toll in Cebu at nine.

More than 260 were wounded on Cebu and Bohol islands.

President Benigno Aquino said he would visit earthquake-damaged areas on Wednesday. "Many of the structures there are old," he told reporters after attending the briefing.

The death toll looks bound to rise. Dennis Agustin, Bohol provincial police director, said in a radio interview as many as 77 people had died in 11 towns on the island, much of which was left without power and communications.

Four bridges and some government buildings collapsed in Bohol. Roads cracked, with many declared impassable due to landslides, prompting the authorities to declare a state of calamity in the province, along with Cebu.

Renato Solidum, head of the state seismology agency, said the magnitude 7.2 tremor had struck near Carmen town on Bohol island at 8:12 a.m. (8.12 p.m. ET).

"A magnitude 7 earthquake has energy equivalent to around 32 Hiroshima atomic bombs. Compared to the 2010 Haiti earthquake -- that had a magnitude of 7.0, this one had a magnitude of 7.2, slightly stronger," he told a news conference.

The volcanology agency said it was measured at a depth of about 56 km (35 miles).

GIRL DIES IN STAMPEDE

Hospitals moved patients to open spaces as aftershocks rocked Cebu, a city of about 870,000 people.

Rey Balido, NDRRMC spokesman, said at least eight people who had been queuing for government aid payments in Cebu were hurt in a stampede sparked by the earthquake. A four-year-old girl died in the stampede, said Social Welfare Secretary Corazon Soliman.

Roman Catholic Archbishop Leonardo Medroso of Tagbilaran city in Bohol said two people were killed by falling debris as they were praying in a church in the town of Loon. The church, Bohol's biggest, dates from 1753.

He said a church in Loboc town was also damaged and that both were designated historical treasures. The belfry of the church in Baclayon, one of the oldest in Bohol province, had crumbled and its facade was cracked.

"The quake was really strong. I am 75 years old already, I have undergone so many earthquakes, but this is the strongest I have experienced," he told Philippine television.

Television showed that the belfry of the Basilica Minore del Sto. Nino de Cebu, built in the 1700s, had collapsed.

Transport Secretary Joseph Emilio Abaya told Philippine radio that parts of Tagbilaran port in Bohol had collapsed.

Airline Cebu Pacific canceled flights to Cebu and Bohol due to the aftershocks and damage to airports. Ferry services were also suspended.

Television showed the collapsed viewing deck of Bohol's most famous tourist attraction, the Chocolate Hills in Carmen town, which is at the epicenter of the quake.

There were no reports of any foreign tourists among the casualties.

The volcanology agency said it had recorded nearly 300 aftershocks as of 5 p.m. (5.00 a.m. ET).

Strong earthquakes are common in the central Philippines.

Tens of thousands of people were ordered from their homes when a tsunami warning was issued after an undersea quake in the region in September 2012. One person was killed in that quake, which resulted in only minor damage and small waves.

Why Genetic Testing Is So Important For Sports

Why Genetic Testing Is So Important For Sports

Fast Company has a profile on 23andMe, the de facto public face of genetic testing, that's worth a read just for the look at the underpinnings of the science. But there's a moment in there that teases out the gut punch that can come from that knowledge, and that's closely related to how genetic testing in sports might look.

'The Goldbergs,' 'Trophy Wife' Earn Additional Script Orders

ABC is expressing confidence in its Tuesday-evening comedy lineup.

The network has picked up three additional scripts for freshman comedies The Goldbergs and Trophy Wife, The Hollywood Reporter has learned.

The comedies air as part of ABC's all-new Tuesday lineup, which starts with Marvel's Agents of S.H.I.E.L.D.

The Goldbergs, a 1980s-set, semi-autobiographical comedy from Adam F. Goldberg, had the benefit of a monster bow from Agents of S.H.I.E.L.D. and topped its Sept. 24 competition at 9 p.m. with a 3.2 rating among adults 18-49, ranking as ABC's best comedy launch in more than a year.

PHOTOS: Faces of Fall TV 2013

Family comedy Trophy Wife, meanwhile, drew a 2.3 rating among adults 18-49 in its Tuesday spot at 9:30 p.m.

Both series have slipped in subsequent weeks as S.H.I.E.L.D. has softened in recent weeks.

The ABC comedies join Fox's Dads and Brooklyn Nine-Nine as well as The CW's Reign, Tomorrow People and The Originals as having received additional scripts this season. S.H.I.E.L.D., meanwhile, ranks as the only ABC show that was given a full-season order. Fellow freshman drama Lucky 7 was the season's first cancellation, getting the ax after two episodes on Tuesdays at 10 p.m.

Firas Zahabi: Georges St-Pierre is not planning on retirement any time soon

Is Georges St-Pierre planning on retiring after his UFC 167 bout with Johny Hendricks?

Not so fast, says his trainer.

Firas Zahabi was quoted by the Canadian French language outlet TVA Sports last week as hinting the end of the road might be near for the UFC's longtime welterweight champion. In a translated quote, the head of Montreal's Tri Star gym said "George told me if the occasion should retire after this fight. If he still has the motivation for another training camp, it will continue. Otherwise, he will take his retirement."

But according to Ariel Helwani on Wednesday's edition of UFC Tonight, Zahabi says his words were taken out of context.

Zahabi said that St-Pierre, who has been champion since April, 2008, has always maintained that when he hits the point that he loses his full motivation in his training camps, he will retire from the sport.

But Zahabi said that such is not the case now, as St-Pierre prepares to meet Hendricks on Nov. 16 in Las Vegas. While St-Pierre's previous two training camps, for title defenses against Carlos Condit and Nick Diaz, weren't so great because he was coming off a knee injury, the Hendricks camp has been his best in a long time.

"GSP has always that said if he loses the drive to really go through with a great training camp and push himself, then he will retire," Zahabi said through Helwani. "GSP's camp has been his best in years, last two not so great, because he was so rusty because of the knee injury."

'Brooklyn Nine-Nine' finds humor in humanity

TV

The cast of "Brooklyn Nine-Nine:" L-R: Stephanie Beatriz, Joe Lo Truglio, Andre Braugher, Andy Samberg, Melissa Fumero,Terry Crews and Chelsea Peretti.

Fox Broadcasting Co.

"I grew up around a ton of cultures and ethnicities and sexual preferences in Berkeley," says "Brooklyn Nine-Nine" star Andy Samberg. "To have that be the tone of the show is very comfortable for me, and I'm very happy that people have taken note and said it's a big deal in that it's not treated like a big deal."

Andy Samberg’s “Brooklyn Nine Nine” character, Detective Jake Peralta is seated at his desk at the police precinct, head in hands and hung over when he receives an antidote from fellow detective Amy Santiago (Melissa Fumero), one handed down by her grandfather: a glass of raw egg yolks. “You look like the corpse we just pulled out of the river,” says their commander, Captain Ray Holt (Andre Braugher), as he walks in. Jake plays it off by claiming the drink is part of his fitness routine.

“You should drink it all,” Holt deadpans and pauses. “For your guns.”

It’s an amusing line the way the Emmy-winning Braugher dryly delivers it during a recent taping on the show's Los Angeles set. Samberg is inspired to improvise different endings that involve consuming the drink, insulting Santiago’s grandfather and trying to one-up Braugher. Soon, both actors are cracking up.

The exercise proves that Fox’s new comedy “Brooklyn Nine-Nine” isn’t going for edge. “Parks and Recreation” producing team Dan Goor and Mike Schur have teamed up again to create a throwback workplace comedy that features daily life in a Brooklyn precinct without a laugh track a la “The Big Bang Theory” or a fake documentary crew like “Parks.”

But the show is quietly breaking ground (it has yet to crack five million viewers) with one of the most ethnically diverse casts on broadcast television. Samberg’s star detective is a goofball but skilled investigator whose two bosses are black men—one of whom is gay—and two of his detective peers are Latinas. In the same way that ensemble dramas like “ER,” “Lost” and “Grey’s Anatomy,” paved the way for multiculturalism without tokenism, “Brooklyn Nine-Nine” defies stereotypical comedic expectations and finds the humor in humanity—not skin color or ethnic background or sexual preference.

“The worst kind of comedy, the worst kind of stand-up to me is when they talk about what you’re looking at—‘I’m Jewish’ or ‘I’m wearing glasses,” Samberg said. “You want to hear jokes about life and things you can relate to. I don’t think this show will ever go out of its way to make comments in that regard.”

Instead, the laughs are found in how the stoic and hard-to-read new commander Holt reacts to Peralta’s antics or how badly Santiago wants to beat Peralta’s closure rate—not where they come from or who they sleep with. Detective Charles Boyle (Joe Lo Truglio) is in love with hard-to-get detective Rosa Diaz (Stephanie Beatriz), a tough cookie who doesn’t speak with an accent or acts particularly sassy. Sgt. Terry Jeffords (Terry Crews) is a hulk of a man who has become petrified of fighting crime since he became a father of twin girls; office secretary Gina Linetti (Chelsea Peretti) is just plain insane.

“I was working on this thing for a month before I realized that there’s two black guys running the precinct—and I work on the show!” said Crews during an interview with NBCNews in his dressing room. “I didn’t even think about that, which is so cool because, oh my God, we have all been there. I’ve turned down a lot of stuff where the message was ‘We’re going to be diverse!’ Give me a break. We’re in Brooklyn. If you don’t make it diverse, it looks funny. We are what ‘Friends’ should have been.”

During an interview in the set’s evidence room, Beatriz, who played Sofia Vergara’s character’s sister on “Modern Family” earlier this year, teared up as she described what it means to her to play a Latina whose ethnicity is not the butt of the jokes or the essence of her character.

“I remember as a kid watching TV and looking for myself and not being able to find myself very often,” she said. “There were very few shows I could see myself. I get a little emotional about it because it’s very important. Back in the day, people would go to theater to watch the human story. Now we’re watching it from our houses; to know that there are people who are watching it who can see themselves is a good feeling. I don’t talk about being Latina every day. I also don’t talk about what kind of deodorant I use. It’s something that happens or is a part of me. And it’s the same on the show. It’s almost monumental in its normalcy.”

The producers and casting director Allison Jones assembled the cast of veterans and fresh faces by staying open-minded during auditions. Once Samberg was cast in the lead role, Goor said his team went about making the Brooklyn precinct as realistic as possible without committing any characters to certain backgrounds or ethnicities. “Parks,” which is set in a small Indiana town, also boasts a multi-ethnic cast that includes Aubrey Plaza, Rashida Jones, Retta, and Aziz Ansari alongside star Amy Poehler.

“Our feeling was not calling attention to their ethnicities and not calling attention too much to Captain Holt being gay,’ Goor said. “We just feel like in real life you’re in a workplace and the Latina lady is not referencing the barrio. She’s a person, just like you’re a person. To a certain extent, it’s just writing toward reality.”

For example, Beatriz auditioned for the role of “Megan.” When the producers decided they wanted to hire her, they renamed her “Rosa.” That the two top officers in the precinct turned out to be black men, Goor said, was a function of wanting to work with Crews from the outset and being pleasantly surprised that Braugher, who is known for his dramatic heft, wanted to test his comedy chops. The role of the commander was always written as gay because the writers wanted the new leader to be a hard-working, ambitious policeman who had been held back because he had come out of the closet in the 80s.

“I’m not playing a gay police captain,” Braugher of his first comedic television role. “I’m playing a police captain who happens to be gay. The distinction is large in my mind. The gay police captain is eventually going to be wearing hot pants and singing ‘YMCA.’ The police captain who happens to be gay is going to be a huge collection of personality characteristics and motivations. I’ll get a husband one of these days but he’ll be my sweetheart as opposed to that man candy we bring in for stunt casting.”

In that same way, detective Boyle (Lo Truglio) is trying to win Rosa’s heart without any mamacita jokes or “spicy” references. “I love that these are traits that don’t define the characters,” the former “Reno 911” star said in an interview. “They shouldn’t. The reality of a police precinct in Brooklyn today is what you see here.”

Braugher jokes that he was lost in the “woods of drama” when “Brooklyn Nine-Nine” found him and won him over with its realistic treatment of diversity. “Broadcast TV is very conservative and they’re always concerned about reflecting the audience’s prejudices rather than reflecting the world as it is. When you’re going into people’s homes, there’s a big pressure to be lovable and acceptable. But life is made up of all these juicy parts. I’m not necessarily a fan of that kind of conservatism. I would like to start by holding a mirror up to life. And this is a show that does that.”

ATF raids Ariz. home, arrest alleged white supremacists

FLAGSTAFF, Ariz. (AP) — Two members of a notorious family that authorities say once tried to set up a whites-only nation in America were arrested this week in Arizona on federal firearms charges after a raid on a sprawling ranch netted dozens of weapons and thousands of rounds of ammunition.

Kirby Kehoe and his 37-year-old son, Cheyne, had an initial court appearance Tuesday in Flagstaff. Cheyne Kehoe's attorney declined to discuss the case, while a lawyer for Kirby Kehoe did not immediately respond to requests for comment.

Authorities received a tip that Kirby Kehoe, 65, had weapons on his 40-acre property near Ash Fork, about 140 miles north of Phoenix, said Tom Mangan, a special agent with the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Agents who raided the property seized dozens of guns, including shotguns and semi-automatic rifles and pistols, according to the ATF. Kirby Kehoe was arrested on site, while federal authorities picked up Cheyne Kehoe in Prescott, where he had a scheduled court appearance in another case.

Kirby and Cheyne Kehoe both have previous felony convictions and are banned from possessing firearms. Each faces one charge stemming from the raid, but Mangan said the list could grow to include more weapons and narcotics charges.

The Kehoe family has been well-known to law enforcement since the 1990s when authorities say they provided weapons to various white supremacists who committed robberies across the Midwest. Authorities also said the family was involved in a plot to overthrow the federal government and establish the Aryan Peoples Republic in the Pacific Northwest.

Another son, Chevie Kehoe, is serving a life sentence in federal prison for his role in the 1996 killings of an Arkansas gun dealer, his wife and their 8-year-old daughter as part of the plot.

Cheyne Kehoe was sentenced in 1998 to more than 24 years in prison for his role in a shootout with Ohio police during a traffic stop about 40 miles northeast of Cincinnati. His sentence later was reduced to 11 years. No officers were injured in the gun battle, but a passer-by was wounded by a bullet fragment.

The family patriarch, Kirby Kehoe, was sentenced in 1999 to nearly four years in prison for racketeering and possession of illegal weapons in a case related to the plot aimed at overthrowing the government. The elder Kehoe, however, has maintained he was never involved in his sons' efforts to establish a whites-only nation and that he isn't a racist.

Mangan said due to the violent nature of the family's past, authorities planned the Monday raid carefully, first setting up surveillance on the property before moving in with search warrants, heavily armed tactical teams and armored vehicles.

He said the raid was conducted in cooperation with law enforcement from around the country and was planned to avoid the potential for a violent confrontation.

"The reason and rationale for having executed the warrant on the property in that manner was driven by public safety, just based on the past history of this individual and the sons," Mangan said Tuesday. "When a traffic stop was being conducted in Ohio, it turned into a nationwide manhunt, and we obviously didn't want to revisit that issue."

Kirby Kehoe is due back in court Thursday for a preliminary and detention hearing. Cheyne Kehoe's next court appearance is set for Oct. 22.

Supreme Court justices to tackle affirmative action in Michigan ban case

Andrew Burton / Getty Images

Students protest in support of affirmative action, outside the Supreme Court during the hearing of "Schuette v. Coalition to Defend Affirmative Action" on Oct. 15, in Washington.

By Pete Williams and Daniel Arkin, NBC News

Demonstrators crowded the sidewalk outside the U.S. Supreme Court on Tuesday as the justices took on the hot-button issue of affirmative action, hearing oral arguments in a case about Michigan's voter-backed ban on using race as a criterion in college admissions.

The gathered advocates urged the top court to stand by a 2003 ruling which held that the country's colleges can choose to use affirmative action practices in deciding which students to admit.

At issue is whether a 2006 Michigan constitutional amendment that blocks the state from taking account of race and gender in public education, employment and contracting constitutes discrimination or preferential treatment.

"It's wrong to treat people differently based on your race or the color of your skin," said Michigan's attorney general Bill Schuette, whose office is defending the Proposal 2 measure. "So we're saying: 'Equal treatment under the law.' That's our approach in Michigan."

But opponents of the ban sued and won in a federal appeals court, arguing that the prohibition is tantamount to discrimination, blocking only minority students from seeking preferences in school admissions.

During Tuesday’s courtroom argument, Mark Rosenbaum, a lawyer for the American Civil Liberties Union who argued to strike down the Michigan measure on behalf of University of Michigan students and faculty, said that other groups pursuing preferential treatment in school admissions could appeal to administrators, only race may not enter the conversation.

“I want the same rule book. I want the same playing field. The problem with Proposal 2 is that it creates two playing fields,” Rosenbaum said, according to the Associated Press.

Shanta Driver, a Detroit-based lawyer also arguing in support of affirmative action on behalf of the Coalition to Defend Affirmative Action, called on the justices to bring the Constitution’s Equal Protection Clause “back to its original purpose and meaning, which is to protect minority rights against a white majority, which did not occur in this case.”

Justice Sonia Sotomayor was the most outspoken justice on the bench about the Michigan ban, at one point saying: "It was intended to bring back segregation, and appears to have done just that."

When Michigan Solicitor General John Bursch, the state's representative in court, suggested Michigan could get rid of legacy admissions as a way to admit a more diverse student body, Justice Sotomayor remarked: "The minorities finally get in and have children, and now you want to do away with alumni preferences."

And yet a bare majority of the justices appeared to believe that Michigan's ban could withstand a constitutional challenge.

Chief Justice John Roberts asked: "Why can't a state say, 'Do all you can to achieve diversity without racial preferences?'"

And Justice Antonin Scalia defended the Michigan measure, which 58 percent of the state's voters approved, saying: "It's not a racial classification. It's the elimination of racial classification."

No matter the outcome of Schuette v. Coalition to Defend Affirmative Action, any ruling is likely to fan the flames of the decades-old debate over affirmative action.

A ruling that strikes down the Michigan ban could send dominoes toppling across the country, potentially threatening bans in seven other states — Arizona, California, Florida, Nebraska, New Hampshire, Oklahoma and Washington.

And a move to uphold the Michigan amendment could represent a victory for affirmative action opponents, who may attempt to recreate their wins at the ballot box in other jurisdictions.

Tuesday's oral arguments came just four months after the justices avoided a major decision on the race-based admissions policy at the University of Texas at Austin, ruling instead to send the closely-watched case back to the lower court.

In a June 7-1 vote, with Justice Elena Kagan having recused herself, the justices said an appeals court did not apply the proper standard in determining whether the university's policy runs afoul of the Equal Protection Clause of the Constitution.

That case, Fisher v. University of Texas at Austin, was brought by a white student who claimed she was turned away from the University of Texas while racial minority students with lower standardized test scores were mailed acceptance letters.

The Michigan case arrives at the Supreme Court after time in front of a federal appeals court in Cincinnati.

The 6th U.S. Circuit Court of Appeals, in an 8-7 decision, said the Michigan provision violates the Equal Protection Clause of the 14th Amendment of the Constitution as it places a burden on affirmative action boosters who would be forced to launch their own extensive, circuitous campaign to strip the constitutional provision, according to the AP.

That burden "undermines the Equal Protection Clause's guarantee that all citizens ought to have equal access to the tools of political change," Judge R. Guy Cole, Jr., write for the majority on the Cincinnati appeals court.

Opponents allege that due to the ban, proponents for racial considerations in admissions are blocked from directly lobbying universities like those seeking to use other advantages — such as family alumni "legacy," for example.

Instead, those opponents would be required to push for the passage of an entirely new amendment to the state constitution, reversing the 2006 voter-backed measure, Reuters reported.

The Michigan case, like the Texas one, will be heard by only eight of the top court's nine justices. Justice Kagan, who prior to her 2010 appointment was the U.S. solicitor general and managed some affirmative action litigation, has rescued herself.

The long-simmering debate over affirmative action dates back to the early 1960s, when President John K. Kennedy first called on federal contractors to take "affirmative action" to hire racial and ethnic minorities, according to the National Conference of State Legislatures.

In a 1961 Executive Order, President Kennedy directed government employers to take "affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, creed, color, or national origin."

For more than a quarter-century, the Supreme Court has often been at the center of pitched legal and political battles surrounding the issue.

In the watershed Regents of the University of California v. Bakke case in 1978, brought by white aspiring medical student Allan Bakke, the top court outlawed quotas but said educational institutions could balance race against other admissions criteria.

African-American and Latino enrollment at the University of Michigan has plummeted since the prohibition on affirmative action went into affect, according to the AP.

And at California's leading public universities, African-Americans make up a smaller share of incoming freshmen, while Latino enrollment has spiked slightly — although still far below the state's growth in the overall percentage of Latino high school graduates, according to the AP.

Some 86 percent of people surveyed by Pew Research said society "should do what is necessary to make sure that everyone has an equal opportunity to succeed." And yet only a third of Americans surveyed agreed with the statement: "We should make every possible effort to improve the position of blacks and other minorities, even if it means giving them preferential treatment."
